In Maryland, there are two types of claims that can be filed if someone is negligently killed in an accident. The first action that a decedent’s personal representative can file is called a “Survival Act.” The purpose of the Survivorship Act is to compensate the victim’s estate for damages and expenses incurred from the time of the accident until their death.
This can include hospital bills, lost wages before death, as well as funeral expenses. Additionally, a survivorship action was intended to compensate the victim for the pain they suffered prior to their death, the fear of knowing they were going to die, as well as the potential cost of burial.
Another type of claim that can be filed after the death of a son or daughter in an accident is called a wrongful death act. In a wrongful death claim, surviving relatives are claiming death damages.
